Dual Agency is typically not a good idea and it is illegal in South Carolina without written consent from the Buyer and Seller, Dual Agency Agreement. Therefore, as commercial real estate Buyer Agents our fiduciary duty is to our Client. These duties are as follows: Care, Obedience, Loyalty, Disclosure, Accounting and Confidentiality.
Do I need a Commercial Real Estate Buyer Agent?
A Commercial Buyer Agent is an agent that represents the Buyer in a commercial real estate transaction. As described in the SC Agency Disclosure section and document referenced above, the commercial buyer agent has fiduciary duties to the Buyer through the Representation Agreement contract. At a minimum your motive, identity, and budget are confidential to every Seller…listed or not. Additionally, your buyer agent understands what you are looking for and how to find it. Your time is only invested in reviewing pre-qualified opportunities. You can buy unique properties that are not on the market. And at all times you have a professional advocating for your best interest from start to finish.

What a Commercial Buyer Agency is not
The opposite of a Commercial Real Estate Buyer Agency is a Commercial Real Estate Listing Agency. The listing agency focuses on marketing commercial properties for sale. If a commercial real estate agency advertises property for sale on their website, on other real estate sites, or with signage along the road…they represent Sellers…specifically Their Sellers. Anyone calling on a sign or clicking a listing link is a lead for their Seller. What is the Broker’s job? Hmmm…Who is paying them? Yep, they are paid to sell you their Seller’s property even if it isn’t ideal for you. Why would they do that? As referenced above, when a Buyer or Seller engages/hires a commercial real estate broker to represent them, they are afforded fiduciary duties by their agent. The Seller Agent or Listing Agent looks out for the Seller first and only unless the Buyer and Seller agree to allow the Agency to represent them both which is called Dual Agency. I know, kind of dicey.
You may say, “Every agency I look at, except this one, has listings”…yes they do! And each agency is obligated, and paid, to look after their sellers’ interests over yours. Yes, you can be a buyer client of a listing agency, but does that make sense?

What to Expect
First, we need to meet and qualify each other. Once we do that, we will establish our working relationship through a Commercial Real Estate Buyer’s Representation Agreement. Along with establishing our fiduciary relationship, this agreement defines the commercial property or development land sought, the time frame to find it, and the fee for successfully closing on your ideal property.
Second, we need to establish the criteria that define the commercial property you require. Criteria that may be important to you could include: land size and attributes, building type and size, zoning, customer demographics, and traffic. All of your criteria are combined to determine the ideal locations to search for your ideal property.
Third, we build a GIS model specific to your commercial property requirements. GIS technology allows us to combine your list into a map layer that tells us where to look. Consequently, we find individual properties that match as many of your criteria as possible. Notice we have not yet opened a browser to see what is listed.
Fourth, we contact each of the pre-qualified commercial property owners directly. Listed property owners are asked to have their brokers call us; every other seller is a unique buying opportunity that only you are seeing. We put you on the inside track ahead of your competition.
Lastly, we help you negotiate and contract your ideal commercial property. While most commercial buyers have a team comprising of an attorney, engineer, planner, etc. to aid with due diligence and closing we are with you to handle anything else prior to closing.
Your new neighbors or competition will say, “I would have bought that if I had known it was for sale!?”. Whatever you decide to say should always be followed by a wink!
